Judge dismisses Blake Lively's sexual harassment claims against Justin Baldoni

A federal judge in New York tossed out actor Blake Lively'ssexual harassment claimsThursday against actor Justin Baldoni over their roles in the movie "It Ends With Us," but he left intact two retaliation claims, which will let a jury hear many of the allegations anyway.

The 152-page ruling by Judge Lewis J. Liman in Manhattan came after Lively sued Baldoni in December 2024, alleging sexual harassment among more than a dozen claims against Baldoni and other parties.

A trial is scheduled to start on May 18. A brief phone conference was conducted after Liman issued his ruling. On the call, lawyers discussed the process of jury selection for the trial.

Baldoni, who directed the movie and co-starred opposite Lively, has denied the sexual harassment claims.

Baldoni and his production company Wayfarer Studios had countersued for $400 million against Lively and her husband, "Deadpool" actor Ryan Reynolds, accusing them of defamation and extortion. The judgedismissed Baldoni's claimslast June.

In his ruling, Liman determined that Lively was an independent contractor rather than an employee. On that basis, he said she was not entitled to bring sexual harassment claims under Title VII of the Civil Rights Act of 1964. That law prohibits employment discrimination on various grounds, including gender.

In an analysis of the sexual harassment claims, the judge said Lively's claims had to be viewed in the context of the movie they were working on.

"Lively claims that during filming, Baldoni leaned in and gestured as if he was intending to kiss her, and that he kissed her forehead, rubbed his face and mouth against her neck, put his thumb to her mouth and flicked her lower lip, caressed her, and leaned into her neck, saying 'it smells good,'" the judge wrote.

He said there was no question that the conduct would support a hostile work environment claim if it happened on a factory floor or in an executive suite.

However, the judge noted, Baldoni was "acting in the scene."

"Assuming he was improvising, the conduct was not so far beyond what might reasonably be expected to take place between two characters during a slow dancing scene such that an inference of hostile treatment on the basis of sex would arise. At least in isolation, the conduct was directed to Lively's character rather than to Lively herself," he wrote.

"Creative artists, no less than comedy room writers, must have some amount of space to experiment within the bounds of an agreed script without fear of being held liable for sexual harassment," Liman added.

Despite those findings, the judge said some sexual harassment claims may be put to a jury to support two retaliation claims that survived the ruling, including one against It Ends With Us Movie LLC and Wayfarer Studios, and a third claim that was left intact, alleging breach of a contract rider agreement against It Ends With Us Movie LLC.

The judge noted that Baldoni once said "pretty hot" after asking Lively to remove her jacket, exposing a lace bra underneath, and that when he was warned that it was inappropriate and distracting to make such comment, he allegedly rolled his eyes and responded: "Sorry, I missed the sexual harassment training."

Liman also cited a scene in which Baldoni pushed for Lively to perform a birth scene naked and then the scene was filmed over several hours without the set being closed to nonessential personnel.

Attorneys for Baldoni said in a statement to CBS News that they're "very pleased" the court dismissed the sexual harassment claims, stating they were "very serious allegations."

"What's left is a significantly narrowed case, and we look forward to presenting our defense to the remaining claims in court," attorneys Alexandra Shapiro and Jonathan Bach said in a statement.

An attorney for Lively said in a statement to CBS News that the case "has always been and will remain focused on the devastating retaliation and the extraordinary steps the defendants took to destroy Blake Lively's reputation because she stood up for safety on the set and that is the case that is going to trial."

"For Blake Lively, the greatest measure of justice is that the people and the playbook behind these coordinated digital attacks have been exposed and are already being held accountable by other women they've targeted," said Sigrid McCawley, an attorney for Lively. "She looks forward to testifying at trial and continuing to shine a light on this vicious form of online retaliation so that it becomes easier to detect and fight."

In February 2025, Livelyalleged in an amended complaintthat Baldoni made other women uncomfortable on the set of "It Ends with Us."

"It Ends With Us," an adaptation of Colleen Hoover's bestselling 2016 novel that begins as a romance but takes a dark turn into domestic violence, wasreleased in August 2024, exceeding box office expectations with a $50 million debut. But the movie's release was shrouded by speculation over discord between Lively and Baldoni.

Lively appeared in the 2005 film "The Sisterhood of the Traveling Pants" and the TV series "Gossip Girl" from 2007 to 2012 before starring in films including "The Town" and "The Shallows."

Baldoni starred in the TV comedy "Jane the Virgin," directed the 2019 film "Five Feet Apart" and wrote "Man Enough," a book challenging traditional notions of masculinity.

Pirates fans shouldn’t worry either after Skenes returned to form on Wednesday.

The reigning NL Cy Young winner allowed one run in five innings and struck out five in thePirates’ 8-3 winover the Cincinnati Reds.

“I’m pretty insulated from a lot of stuff that’s out there. The stuff that I do see or hear, I don’t really care anyway because it doesn’t have anything to do with the play. I’m just thinking about getting back to execution and executing my pitches,” Skenes said. “Nothing matters except for the game and the pitches.”

Skenes walked Cincinnati’s TJ Friedl, then retired eight straight, including three strikeouts. He walked Friedl twice in three innings before Elly De La Cruz singled for the Reds’ first hit. Two batters later, Nathaniel Lowe doubled in De La Cruz, ending Skenes’ 31-inning scoreless streak against Cincinnati.

Skenes’ scoreless run was the fourth-longest by a Pirates pitcher against an opponent since 1961. Vernon Law holds the mark, blanking the Mets for 40 innings during 1965-66.

The right-hander retired four of the last five batters he faced and departed after throwing 77 pitches, including 51 strikes.

“Definitely progress. Nice to get some volume and be out there for more than two-thirds,” said Skenes, who improved to 5-0 with a 0.53 ERA in six career starts against the Reds. He has 45 strikeouts and only four walks while holding Cincinnati to a .197 batting average.

Further helping Skenes, the Pirates gave strong run support, scoring three in the first on Oneil Cruz’s homer to right.

“With Skenes on the mound, you hate to give them anything early because you know you’re going to have to fight to get anything you can get,” Reds manager Terry Francona said.

Manager Don Kelly said he wanted to avoid overworking Skenes early, especially after his 37-pitch, two-thirds-inning start in the Mets’ opening day win on Thursday. Skenes allowed five runs, tying a career high, with two walks and a strikeout in the 11-7 loss.

“When you’re going off one outing and 37 pitches, we had targeted 80 for him,” Kelly said. “It was something that we need Paul for the long haul, and he did a great job getting through five. As we go, he’s going to be throwing more than five (innings) and 77 (pitches).”

Skenes has a 2.10 ERA through his first 57 starts, the fourth-best mark by any pitcher since 1920. It is also the lowest mark by a Pittsburgh hurler in any span of 57 starts since Babe Adams had a 2.06 ERA between 1918 and ’20.

For the past couple of weeks, the actress, 29, has been on a bridal kick onThe Dramapress tour, having come up with the concept of wearing something old, something new, something borrowed, something blue, inspired by the classic wedding tradition.

For the something borrowed element, executed at the movie's Rome premiere, her stylist, Law Roach,dressed her in a Giorgio Armani gownoriginally worn byCate Blanchett(the queen of outfit recycling) at the 2025 Venice Film Festival.

It was a "dream come true" for Zendaya, who also admitted that the loan came with high stakes.

“I thought it was such a kind thing to share. I was very paranoid about spilling [anything on] or breaking or doing anything wrong to the dress," she said during her appearance onThe Tonight Show.

The Emmy winner said that Blanchett was "one of the first people I thought of" because of how great the ensemble was. When she first saw it, she thought, "I wish I could wear that dress. What a dress.”

Zendaya has had a few "what a dress" moments on this press run. She's worn a white Vivienne Westwood dress first seen on her at the2015 Academy Awards(her "something old"), acustom Louis Vuitton number(her "something new") and an indigo blue Zimmerman lace dress (which is not her "something blue," per Roach, but what we can only assume is a lead-in to theactual"something blue").

It's not just the dresses that have sparked buzz, though. Zendaya has also been seen wearing whatappears to be a wedding band, along with her engagement ring, on various outings following Roach's admission that she and Tom Hollandsecretly tied the knotduring an interview at the2026 Actor Awards.

"In a lot of ways, I’m also a very private person and I try my best to be able to have things for myself and for him as well," she said, continuing with her outlook on wanting to balance privacy with public celebration. "I just try to find the balance in the middle there."

TMZshared that Sai’s husband, David just filed for divorce in New York City, according to court records. The couple was still out at events together as recently as late last year.

They met in Costa Rica in 2009. According to Sai, David caught her attention and made her laugh. They began dating but didn’t marry until years later.

The couple tied the knot in 2017. They have two children together, a daughter, London, who was born in 2011, and a son, Rio, who was born in 2017, right before the couple exchanged vows.

For the most part, they didn’t find themselves in much controversy (as is usually the case with Housewives marriages right before the split). Sai is comfortable in the spotlight, while David is more private. He has barely appeared on Sai’s social media over the years, although she has shared that he is very involved as a dad.

David has appeared a couple of times on RHONY after Sai joined the franchise during acast shakeup rebootduring Season 14. The show iscurrently shooting Season 16, so fans will likely see a bit of what happened with the pair when the newest season airs.
